Introduction
These Terms of Service (“Terms”) govern the access to and use of the Unmanned Aircraft Traffic Management (“UTM”) and related services (collectively, the “Services”) provided by Anomaa Aerospace Technologies (“Company,” “we,” “our,” or “us”).
By registering for, accessing, or using the Services, you (“User,” “Operator,” “Customer,” or “you”) agree to comply with these Terms.
If you do not agree to these Terms, you may not access or use the Services.
Definitions
- Aircraft means any unmanned aircraft, drone, or remotely piloted aircraft system using the Services.
- Operator means any individual, organization, government agency, or entity operating an aircraft using the Services.
- UTM Platform means the Company’s software, systems, infrastructure, and technologies used to facilitate drone traffic management and airspace coordination.
- Operational Data means flight plans, telemetry data, position reports, route information, safety alerts, and related flight information.
- Regulatory Authority means any aviation regulator, airspace authority, government agency, or competent authority having jurisdiction.
Description of Services
The Company provides technology-enabled services that may include:
- Drone traffic management
- Flight planning and scheduling
- Airspace coordination
- Flight authorization management
- Airspace monitoring
- Geofencing services
- Conflict detection and deconfliction
- Remote identification support
- Airspace restriction notifications
- Fleet management support
- Real-time traffic awareness
- Safety monitoring
- Incident reporting
- Integration with aviation and regulatory systems
The Company reserves the right to modify, suspend, or discontinue any Service at any time.
Eligibility
To use the Services, you must:
- Be legally authorized to operate drones or manage drone operations
- Possess any licenses, certifications, registrations, or approvals required by applicable law
- Have authority to bind your organization where registering on behalf of a business or government entity
- Provide accurate registration and operational information
The Company may request evidence of compliance at any time.
User Registration and Accounts
Users may be required to establish an account before accessing certain Services. Users agree to:
- Provide accurate information
- Maintain current records
- Protect login credentials
- Immediately report unauthorized account activity
- Accept responsibility for activities conducted through their accounts
The Company may suspend or disable accounts suspected of fraud, misuse, or security risks.
Regulatory Compliance
Users are solely responsible for complying with:
- Civil aviation regulations
- Drone registration requirements
- Pilot licensing requirements
- Operational authorizations
- National security restrictions
- Privacy laws
- Data protection laws
- Telecommunications regulations
- Any other applicable laws and regulations
Use of the Services does not constitute governmental authorization to operate an aircraft. The Operator remains solely responsible for obtaining all required approvals and permissions.
Flight Planning and Airspace Coordination
The Services may assist Users in:
- Planning flight operations
- Submitting flight information
- Receiving airspace advisories
- Avoiding restricted areas
- Coordinating with other airspace users
The Company does not guarantee: availability of airspace, approval of flight requests, absence of conflicting traffic, or successful completion of planned operations. Flight decisions remain the responsibility of the Operator.
Operational Data Submission
Users may submit operational information including: flight plans, launch and recovery locations, flight paths, mission objectives, aircraft identifiers, contact information, and authorization documentation.
Users warrant that all submitted information is accurate, complete, and lawful.
Airspace Information and Advisories
The Company may provide traffic information, automatic geofencing and weather information integration or updates, airspace notices, and operational advisories.
Such information is provided for operational support purposes only. The User acknowledges that information may occasionally contain errors, omissions, delays, or inaccuracies. Operators remain responsible for making final operational decisions.
Operator Responsibilities
The Operator shall:
- Conduct safe operations at all times
- Maintain visual observation where required
- Follow applicable aviation rules
- Monitor operational conditions
- Maintain operational control of aircraft
- Respond appropriately to emergencies
- Ensure aircraft airworthiness
- Maintain qualified personnel
- Use the Services responsibly
Operators are solely responsible for all flight operations.
Prohibited Activities
Users shall not:
- Submit false operational information
- Circumvent safety controls
- Tamper with platform functionality
- Operate unauthorized aircraft
- Attempt to gain unauthorized access to systems
- Interfere with other airspace users
- Disrupt communications infrastructure
- Use the Services for unlawful purposes
- Engage in fraudulent activities
- Violate intellectual property rights
The Company reserves the right to investigate and report violations.
Safety and Emergency Operations
The Company may: restrict operations, suspend airspace access, override scheduled activities, issue safety notifications, and prioritize emergency operations.
Users must comply with reasonable safety-related instructions issued through the platform.
Data Sharing and Regulatory Reporting
The User acknowledges that operational information may be disclosed to:
- Aviation authorities
- Air navigation service providers
- Law enforcement agencies
- Emergency services
- National security agencies
- Authorized airspace stakeholders
Such disclosures may occur where required by law, safety considerations, or regulatory obligations.
Service Availability
The Company strives to maintain reliable Services but does not guarantee continuous availability, uninterrupted access, error-free operation, real-time performance, or compatibility with all systems.
Services may be affected by network failures, cybersecurity incidents, technical maintenance, third-party outages, regulatory restrictions, or force majeure events.
Intellectual Property Rights
All rights, title, and interest in the Services, including software, platforms, algorithms, databases, documentation, trademarks, logos, and proprietary technology, remain the exclusive property of the Company or its licensors.
No ownership rights are transferred to Users.
Confidentiality
Users shall protect confidential information obtained through the Services. Confidential information may include operational procedures, technical specifications, business information, non-public airspace data, and security protocols.
Confidential information may not be disclosed without authorization except where legally required.
Fees and Payment
Users agree to pay all applicable charges associated with the Services. Fees may include subscription fees, service access fees, transaction fees, enterprise service fees, and integration fees.
The Company reserves the right to modify pricing upon reasonable notice. Failure to pay may result in suspension or termination of Services.
Suspension and Termination
The Company may suspend or terminate access if these Terms are violated, regulatory concerns arise, security risks are identified, safety risks are presented, required fees remain unpaid, or fraudulent activity is suspected.
Termination shall not affect accrued rights and obligations.
Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for flight delays, operational disruptions, airspace denials, lost business opportunities, loss of revenue, data interruptions, indirect damages, consequential damages, special damages, or punitive damages.
The Company’s total liability arising from the Services shall not exceed the fees paid by the User during the twelve (12) months preceding the event giving rise to the claim.
Indemnification
Users agree to indemnify and hold harmless the Company, its employees, officers, directors, agents, and partners against all claims, losses, liabilities, damages, costs, and expenses arising from flight operations, regulatory violations, user misconduct, negligence, incorrect operational data, breach of these Terms, or violations of third-party rights.
Force Majeure
The Company shall not be liable for any delay, interruption, or failure resulting from circumstances beyond its reasonable control, including natural disasters, severe weather, government actions, armed conflict, civil unrest, telecommunications failures, cyberattacks, power outages, pandemic events, or airspace closures.
Privacy and Data Protection
The collection, use, disclosure, and protection of information shall be governed by the Company’s Privacy Policy.
By using the Services, Users consent to the processing of operational, technical, and personal information necessary for the delivery of the Services.
Amendments
The Company may modify these Terms from time to time. Updated Terms shall be published through appropriate channels and become effective upon publication unless stated otherwise. Continued use of the Services constitutes acceptance of the revised Terms.
Dispute Resolution
Any dispute arising from these Terms shall first be addressed through good-faith negotiations between the parties. If a dispute cannot be resolved through negotiation, it shall be submitted to mediation, and thereafter binding arbitration or the courts of competent jurisdiction in the Republic of Ghana.
These Terms shall be governed by the laws of the Republic of Ghana.

Entire Agreement
These Terms constitute the entire agreement between the User and the Company regarding the Services and supersede all prior agreements, understandings, representations, and communications relating to the subject matter herein.
Acknowledgment
By accessing or using the Drone Traffic Management Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
